Await a response–your spouse will have 21-28 days from the day that they are served to respond to your complaint. If more than 21 days pass, you may have grounds to pursue a default divorce.

Contested vs. uncontested divorce–if the divorce is contested, this means that your spouse is in disagreement about your proposed terms. The divorce will proceed as a contested divorce, which will require mediation and, if mediation fails, then litigation. It is important to have a local Detroit divorce attorney to fight for you during the case. They will gather evidence during something called the Discovery process and prepare your case for trial.  An uncontested divorce is where a couple executes a settlement agreement resolving all of their issues and a local divorce attorney prepares and submits the paperwork to the Court. Understanding the Types of Divorce in Michigan 

In Michigan, there are several different types of divorce actions that a person can file. The most common types are:

Uncontested Divorce: This kind of divorce happens when there is total agreement from both parties on the terms of the divorce, including the division of property, custody of children, and alimony. Uncontested divorces are typically faster and less expensive than other types of divorce.

Contested Divorce: This occurs when the parties do not agree on one or more terms of the divorce. This type of divorce can be more complicated and may require court hearings and mediation.

No-Fault Divorce: This happens when a party files for divorce on the grounds that the marriage has irretrievably broken down and that there is no chance of reconciliation. Michigan has “no-fault” divorce. No-fault means you don't have to prove cheating, abandonment, cruelty, or anything else to get a divorce. No-fault divorce is the most common type of divorce in Michigan, and it can be either uncontested or contested.


Michigan Residency Requirements for Divorce

In order to properly file for a divorce in Michigan, one of the two spouses must have lived within the State of Michigan for a minimum of 180 days before the divorce complaint is filed. Additionally, one of the spouses must have lived in the county where the Complaint is filed for at least 10 days immediately prior to the filing of the Complaint.

Once the divorce papers (in Michigan Called  "Complaint") are filed with court, the divorce process depends greatly on how easily and amicably the outstanding issues between the spouses can be settled. Most divorces are in some way contested and you will need to take steps to reach a mutual understanding on contentious issues or ask a judge to decide.

Typically, the most hotly contested issues in a divorce are as follows:

Child custody: who has legal and physical custody of the children is a primary issue that can hold up a divorce if no agreement can be reached.

Child support: the amount of child support due from the non-custodial parent to the custodial parent (if any) must be calculated and agreed upon. These calculations should include the children’s school, extracurricular, insurance, and uninsured medical expenses.


Property and debt division: in Michigan, anything considered marital property (as opposed to separate property) must be divided down the middle unless the spouses agree otherwise. The same applies to marital debt.


Spousal support (alimony): sometimes, spousal support is required to help one spouse make the financial transition to self-sufficiency—if so, an agreeable amount and duration of payment must be decided.
